Local Law 26 — Sprinkler Retrofit for High-Rise Office Buildings

Local Law 26 of 2004 mandated the retroactive installation of automatic sprinkler systems in high-rise office buildings (100 feet or taller) that were built before July 1, 2004 and did not already have complete sprinkler coverage. The law was enacted following the World Trade Center disaster to reduce fire risk in older commercial high-rises.

Who is covered

Buildings 100 feet or taller with Group B (business) or Group E (educational) occupancies that were built before July 1, 2004 and lack a complete automatic sprinkler system.

What the law requires

  • Install a complete automatic sprinkler system throughout the building, or demonstrate compliance through an approved alternative.
  • File sprinkler installation plans with DOB and obtain the necessary permits.
  • FDNY fire suppression inspection upon completion.

Penalty structure

Non-compliance with LL26 (Sprinkler) can result in the following penalties:

  • Ongoing violation status with potential vacate orders.
  • DOB may restrict building permits and certificates of occupancy.
  • FDNY may issue additional fire code violations.

Exemptions

  • Buildings with existing full sprinkler coverage.
  • Buildings under 100 feet in height.
  • Residential and non-office occupancies.

Recent updates and amendments

Most covered buildings have now complied. DOB continues to enforce against remaining non-compliant properties through permit restrictions and violation issuance.
