ACP-5 — Asbestos Assessment (pre-permit)

Before DOB issues a permit for work that could disturb building material, a DEP ACP-5 Asbestos Assessment Report (signed by a Certified Asbestos Investigator) must be filed and accepted — unless a full Asbestos Project is undertaken.

Owners undertaking renovation, alteration, or demolition work that could disturb material requiring a DOB permit.

What the law requires

  • Engage a DEP-Certified Asbestos Investigator (CAI) before filing for the DOB permit.
  • File the ACP-5 (or pursue a full Asbestos Project / ACP-7 abatement) and obtain DEP acceptance.
  • For full demolition, ensure the ACP-5 reflects the entire building is asbestos-free.

  • DOB will not issue the permit without an accepted ACP-5; DEP penalties for improper asbestos work.
