New construction and major alterations require NYC Energy Code (NYCECC) progress inspections during construction and a sealed TR8 + EN2 before DOB sign-off. This is distinct from the ongoing LL97 emissions-cap regime.

Owners of new construction or major alteration projects affecting the thermal envelope or energy systems.

What the law requires

  • Engage a qualified Energy Code progress inspector through an approved agency at filing.
  • Complete the required progress inspections as construction proceeds.
  • Have the TR8 (Statement of Responsibility) and EN2 completed/sealed; provide an as-built energy analysis if as-built differs.

Non-compliance with Energy Code TR8 can result in the following penalties:

  • DOB will not sign off / issue a CO without certified Energy Code progress inspections.

Exemptions

  • Work that does not touch the thermal envelope or regulated energy systems.

TR8 (construction-phase Energy Code) is separate from LL97 emissions reporting — don't conflate the two.
