Owners of new construction or major alteration projects affecting the thermal envelope or energy systems.
What the law requires
- Engage a qualified Energy Code progress inspector through an approved agency at filing.
- Complete the required progress inspections as construction proceeds.
- Have the TR8 (Statement of Responsibility) and EN2 completed/sealed; provide an as-built energy analysis if as-built differs.

Penalty structure
Non-compliance with Energy Code TR8 can result in the following penalties:
- DOB will not sign off / issue a CO without certified Energy Code progress inspections.
Exemptions
- Work that does not touch the thermal envelope or regulated energy systems.
Recent updates and amendments
TR8 (construction-phase Energy Code) is separate from LL97 emissions reporting — don't conflate the two.
