Local Law 33 — Energy Efficiency Grade Posting

Local Law 33 requires buildings covered by LL84 to post an energy efficiency grade — A, B, C, D, or F — in a conspicuous location near a public entrance. The grade is derived from the ENERGY STAR score calculated during the LL84 benchmarking process. The goal is to increase transparency about energy performance for tenants, buyers, and the public.

Who is covered

All buildings required to benchmark under LL84: buildings over 25,000 gross square feet or same-tax-lot aggregates over 100,000 square feet.

What the law requires

  • Complete LL84 benchmarking to generate an ENERGY STAR score.
  • Obtain the official energy efficiency grade letter from the City.
  • Post the grade near a public entrance in a format and size specified by the City.
  • Update the grade annually after each benchmarking cycle.

Filing frequency and deadlines

Penalty structure

Non-compliance with LL33 can result in the following penalties:

  • $1,250 per year for failure to conspicuously display the energy grade.

Exemptions

  • Same exemptions as LL84 — houses of worship and buildings under the square footage thresholds.

Recent updates and amendments

The City increased compliance checks by cross-referencing LL84 filings with LL33 grade postings. Buildings that file benchmarking data but fail to post the grade are now receiving targeted enforcement notices.
