Who is covered
New construction and major roof renovations with permit applications filed on or after November 15, 2019. Covers most building types and occupancy groups.
What the law requires
- Install a qualifying sustainable roof system — green (vegetated) roof, solar PV, solar thermal, or a combination.
- Cover 100% of the available roof area (the portion not occupied by mechanical equipment, setbacks, or required code clearances).
- Include the sustainable roof plan in the DOB building permit application and obtain sign-off.

Penalty structure
Non-compliance with LL92 / LL94 can result in the following penalties:
- DOB may withhold the building permit or certificate of occupancy if the sustainable roof requirement is not met.
- Revision of construction plans may be required, adding cost and delay.
Exemptions
- R-3 occupancies (one- and two-family homes) of three stories or fewer.
- Projects with permit applications filed before November 15, 2019.
