Local Law 55 — Indoor Allergen Hazard Inspection (Asthma-Free Housing Act)

The Asthma-Free Housing Act requires owners of multiple dwellings to annually inspect each unit for indoor allergen hazards — mold, pests, dust mites, and cockroaches — and remediate within 30 days using safe work practices.

All multiple dwellings (3+ units).

What the law requires

  • Inspect every unit annually and at every vacancy turnover.
  • Remediate identified allergen hazards within 30 days using Integrated Pest Management (IPM) and safe mold work practices.
  • Provide the LL55 notice and pamphlet to tenants annually and at move-in.
  • Maintain inspection and remediation records for 10 years.

Penalty structure

Non-compliance with LL55 (Allergens) can result in the following penalties:

  • HPD violations — Class B (hazardous) for failure to inspect or remediate.
  • Tenant lawsuits and civil penalties for willful non-remediation.

Exemptions
