Local Law 154 — All-Electric / Fossil Fuel Use Restriction

Local Law 154 prohibits the combustion of fossil fuels in new construction. Buildings under seven stories must comply starting with permits filed on or after December 31, 2023; taller buildings follow in 2027. The law is a cornerstone of NYC's building decarbonization strategy.

Who is covered

New construction projects. Small buildings (under 7 stories) comply first; buildings 7+ stories phase in later.

What the law requires

  • Design all space heating, domestic hot water, cooking, and clothes drying to operate without on-site fossil fuel combustion.
  • Electrify HVAC systems (heat pumps), cooking (induction or electric), and water heating.
  • Include LL154 attestation on DOB construction filings.

Penalty structure

Non-compliance with LL154 can result in the following penalties:

  • DOB will not approve construction documents or issue a TCO/CO for non-compliant new buildings.

Exemptions

  • Commercial cooking equipment in restaurants, manufacturing, emergency backup power, and labs.
  • Existing buildings are not required to retrofit under LL154.

Recent updates and amendments

DOB issued implementation guidance in 2024 clarifying the boundary between 'substantial alteration' and 'new construction'.
