Penalty structure
Non-compliance with FDNY EAP Notice can result in the following penalties:
- FDNY violation for failure to distribute or post the required annual fire-safety materials.
Exemptions
- Non-R-2 occupancies (office-building EAPs follow a separate 3 RCNY 404-02 regime).
