Owners of R-2 residential buildings must annually distribute the FDNY fire & emergency preparedness guide/bulletin and the EPC checklist to occupants, and post the required fire-safety, 'close the door,' and related notices.

Who is covered

Owners of Occupancy Group R-2 residential buildings (apartment buildings, including high-rises).

What the law requires

  • Distribute the current FDNY fire & emergency preparedness bulletin to all occupants annually.
  • Distribute the Emergency Preparedness Checklist and post required fire-safety/close-the-door notices.
  • Keep proof of distribution and posting.

Penalty structure

Non-compliance with FDNY EAP Notice can result in the following penalties:

  • FDNY violation for failure to distribute or post the required annual fire-safety materials.

Exemptions

  • Non-R-2 occupancies (office-building EAPs follow a separate 3 RCNY 404-02 regime).
