DEP Boiler Permit

DEP — Fuel-Burning Equipment Permit / Certificate to Operate

Boilers/combustion equipment rated ≥350,000 BTU/hr require a DEP work permit / Certificate to Operate (roughly a 3-year term). This is the DEP air-quality permit — separate from the DOB annual boiler inspection.

Who is covered

Owners/operators of fuel-burning equipment at or above the DEP rating threshold.

What the law requires

  • Confirm the input rating of each boiler/combustion unit against the DEP ≥350 MBTU/hr threshold.
  • File for or renew the DEP work permit / Certificate to Operate before it expires.
  • Larger facilities may also need a Title V air permit with periodic compliance certifications.

Filing frequency and deadlines

Penalty structure

Non-compliance with DEP Boiler Permit can result in the following penalties:

  • DEP Air Pollution Control Code violation for operating without a current permit/registration.

Exemptions

  • Equipment below the DEP ≥350,000 BTU/hr threshold.

Recent updates and amendments

The DOB annual boiler inspection does not cover the DEP air permit — they are separate obligations.
