Local Law 126 — Parking Structure Condition Assessment

Local Law 126 also established a mandatory condition assessment program for parking structures. Every six years, a qualified professional must inspect and report on the structural integrity of enclosed, open, and underground parking garages. Between full inspections, owners must submit an annual condition checklist.

Who is covered

All parking structures in New York City, including underground garages, above-grade garages, open parking decks, and enclosed multi-level parking facilities.

What the law requires

  • Engage a licensed professional engineer to perform a comprehensive condition assessment every six years.
  • File the condition assessment report with DOB.
  • Submit an annual owner's condition checklist between full inspection cycles.
  • Address any structural deficiencies identified in the report within the prescribed timeline.

Non-compliance with LL126 (Parking) can result in the following penalties:

  • $5,000 or more for missed condition assessment filings.

  • Private garages with fewer than 650 square feet and a capacity of two vehicles or fewer.

This program was created in response to the 2023 parking garage collapse in Lower Manhattan, which killed one person and injured several others. Enforcement has been aggressive since the law's adoption.
